| Go ahead and try. All they can do is ban your account permanently.
Microsoft and Xbox Live! consider modding an Xbox (illegal modifications to
their system) as cheating. That'll cost you your account and get you a
permanent ban. 8-)

| Microsoft externally, because they're the ones who cause the machine to be
manufactured, and then the various manufacturers whose parts are used
internally and license to Microsoft. They (their) Xbox Live! system, run by
Microsoft.

| Any modification to the system wouldn't in fact be illegal though, would it?
If you modicy the CPU in your computer to overclock it, its going to void
your warranty, but its not illegal. Same would apply to the xbox. you are
not buying a right to use it, you are buying the hardware, and its yours to
change however you like.
I completely agree that they can and should ban you from XBL because of it,
but modding your system in itself is not illegal.

| Do you have authorization from Microsoft or the various manufacturers of the
components within the Xbox 360 to modify what's there?

| Yes, when they sold me the components, I now own them. Microsoft is
licensed to use the technology to put in their product. I dont need
authorization to modify my own property. Do I need authorization from my
car manufacturer to make modifications to its engine? Nope, even though im
sure its thoroughly licences, and my modifications may make it possible for
me to do something illegal, its my property, and I can do with it as I
please.

Your car's engine isn't protected under the DMCA though. I'm sure some
part of it's anti-copying system falls under there, in which case
reverse-engineering it (or posessing/trafficing tools which are capable
of breaking it) would be illigal. IANAL, of course.

| so I take it from all the comments so far that's its not advisable to go
live but there's no concrete evidence yet so confirm that.

| Sure there is. This is from Xbox Live Terms of Use,
http://www.xbox.com/en-US/live/legal/ :
=====
13. SERVICE OPERATION AND EQUIPMENT
The Service may only be accessed with an original Xbox or Xbox 360 console
or by logging into your account via Xbox.com. If you are accessing the
Service via an original Xbox or Xbox 360 console, you agree that you are
using authorized software and hardware, and that your software and hardware
have not been modified in any unauthorized way (e.g., authorized repairs,
upgrades and downloads). Any attempt to disassemble, decompile, create
derivative works of, reverse engineer, modify, further sublicense,
distribute or use for other purposes either the hardware or software
associated with an original Xbox or Xbox 360 console or the Service, is
strictly prohibited and may result in cancellation of your account and/or
your ability to access the Service via your original Xbox or Xbox 360
console, and the pursuit of other legal remedies by Microsoft. Microsoft may
take any legal action it deems appropriate against users who violate
Microsoft's systems or network security or this contract or any additional
terms as described in Section 2 above, and such users may also incur
criminal and/or civil liability.

| Not that I would ever MOD my Xbox, but all that is saying is it can't be
Modded for use on LIVE! If your not using your Modded Xbox on LIVE, then
who cares. It effects no one else. If a person Mods a Xbox to run Pirated
software, well then that's different and is covered under another Legal
Notice for the Software.
As for the whole CAR Comparison, and the DMCA. Well what do you think runs
Cars these days? Computers with Software. What happens when you plug in a
Power Programmer? Ops You just Changed the Manufactures Software for
better performance. (Like a 360 Mod Chip) The Manufacturers don't give out
the Info on the computers, Nope, they have to be Reversed Engineered by 3rd
party companies to be able to Re-Program them. Read the Codes, Diagnose.
I'm waiting for the day when Chevy, Ford, Doge and others go after HyperTech
and SuperChip and others with the DMCA!
What you do with your OWN hardware you paid for is and should be of no
Interest to anyone else. DO with as you want. In fact you see this with
TIVO's. Though TIVO doesn't outright come out and Endorse it, they don't
try to STOP it unless it's something that can really screw TIVO. Because
of this, TIVO has a huge Following, and some great mods.
Hack your 360 all you want, but stay off LIVE so it's FAIR for everyone.
That's all anyone can ask. MS SHOULD ban you if your Caught with a Modded
360 on LIVE Permanently! Cheating in a game makes it no fun for everyone
else. If you want to cheat by yourself, go for it.

| The original owner of this post never mentioned anything about modding
games, just his box. I mean I would love to mod my box as well, but not for
cheating in online game play. I currently have an original Xbox modded with
a 300 Gb drive in it, it is so much better playing from the hard drive
rather than disks.
1. preserve your disks, prevent scratches
2. game runs smoother, less loading times.
3. a lot more functionality, tons of dash boards, screw ms media center
when you've got XBMC. You can stream anything you want from your pc!
4. you can run a ftp server, a web server... all from your Xbox.
All in all, there are a million reasons to mod an Xbox. weather you take the
illegal route, and download free games off the net, rent them from block
buster and copy them to the HD, or cheat online, that is a decision to be
made only by the owner of the hardware. If you do something wrong, you will
pay the price nuff said!
Now, as far as being able to play a modded 360 online.. I have no clue. I
have hear conflicting answers myself and would also like to know. I'm
interested to see how far the mudding community goes with the 360.
