Author Trouble cancelling XBox Live subscriotion!

2004-12-19, 5:45 pm

Hi everyone,

Could someone please help me with an extremely frustrating problem?

I have an annual XBox-Live subscription which has just been renewed at the
beginning of this month. I have received no notification of the renewal of
this subscription, only saw it by accident on my Credit card statement. I no
longer want this service and anyway, I had to sell the XBox about 4 months
ago because of financial problems!!

So now I am trying to contact them to try and get my £40 subscription back
(half of what I got for the X-Box) , for a service I haven't used, have no
intention of using, and don't have the equipment to use it anyway, but
everytime I phone the phone number I'm just left hanging (I always give up
after an hour) and told that my call is important to them!!

I would be grateful for any help anyone can offer.

I'd contact the credit card company and challenge the charge, first of all.
Then bombard Xbox Live! support in the methods described here:
http://www.xbox.com/en-US/support/S...contact.htm#TOP (The page may be
different for you, because of your location.) They really will listen, once
you get their attention.

As covered at
http://www.xbox.com/en-gb/live/termsofuse.htm
In section 5.4 Subscription Renewal
It states
"... If you are subscribed for longer subscription periods (e.g., 3, 6 or 12
months) then unless the terms of that subscription state otherwise, your
subscription will automatically and continuously renew for such period at
prices then in effect. ..."

and
5.5 Refund Policies.
"... Except as stated otherwise, or as otherwise provided by applicable law,
all charges are non-refundable. ..."

and
15. YOUR TERMINATION OF SERVICE
"... You may terminate the Service at any time, with or without cause, upon
notice to Microsoft by calling Xbox Live Customer Service or as otherwise
specified by Microsoft. ..."

See also
http://www.xbox.com/en-gb/live/accounts/default.htm
For details of the appropriate contact number for the UK and the renewal
process.

So it looks like under the terms of your contract for Xbox Live - you are
responsible for the cancellation of your subscription prior to the automatic
renewal.
Try and contact UK Xbox Live support again (it is a free phone number in the
UK an 0800 number)

Call your Credit card company, dispute the charge, tell them you had
canceled the live subscription.

That may be illegal as the poster had NOT cancelled the subscription.
He is complaining that under the terms of his contract his subscription is
auto renewed. If he wished to cancel the subscription he should have done
so.
If he calls the credit card company and falsely claims to have cancelled the
subscription and he had not (by his own admission in his original post) then
that may be viewed as a fraudulent act.

He can dispute the fact he received no notification of the
automatic renewal. Since he was unaware of it, and maybe
he doesn't recall what the original contract stated a year
ago it would be up to the credit card company and
microsoft to provide that to him through a credit card
dispute. If either party cannot prove the original
contract also I believe by law the money would have to be
refunded. I am not sure how it works in England though.

It does have to be proved on either side of the dispute
whoever is right.

I do not beleiev he is required to receive such notification.
This is a automatically renewing subscription, as per the contract he agreed
to.

But if he wishes to raise this issue with Xbox support he can call the
number on the page I initially provided; as he can also raise this with his
credit card company but this is not really a disputed charge (he did agree
to auto renewal).

The credit card company will usually side with it's customer.
He can tell the credit card company he has tried on several occasions,
tried to contact about getting his subscription canceled, but no one has
picked
up the line at Microsoft, so his only recourse is to dispute the charge.
It will then be up to Microsoft to prove it has the right to charge his
credit card
Which means that Microsoft have to dig through their records to find
something with his
signature on it to prove their end.
My guess is Microsoft will not fight the disputed charge.
Not worth their time.

dunno about the UK, but I've had nothing but excellent customer service from
Microsoft the few times I've had to contact them regarding service issues
(product shipments and refunds). in the states, there's a toll free number
(1-800-4MY-XBOX) for customer service...you probably have something
equivalent.

I have canceled two subscriptions before in the UK by phoning the
support and had no problems, they quickly transferred me through to the
people I needed to talk to. I haven't canceled and tried to get a refund
though.
