| WHAT IS UNTRUE, MR. BAUER? WHAT ARE FRANK BRADY'S FALSEHOODS?
So, then, you have all had an opportunity to view
this message below from Frank Brady. I offer my views
below in multiple brackets on a paragraph by paragraph
basis about whether there are any falsehoods or
arrantly nonsensical misstatements that make it a
moral or professional imperative that Mr. Brady
withdraw the statement.
Compare, then, Mr. Brady's statement below with
Randy Bauer's assertion in October 2004 that the
dangers of legal action against the Federation were so
piffling that Board members had not discussed for
"weeks" a legal letter noting the dangers of NOT
moving to Crossville. Compare that statement with his
remarks a few days ago in which he defended leaving
off legal expenses from his moving cost estimates
because NOT moving carried the danger of far larger
expenses.
Is there anything in the Brady statement below
that is even remotely evidently false or contradictory?
Here then is my paragraph by paragraph commentary.
FRANK BRADY'S MESSAGE
BEATRIZ MARINELLO: "The meeting began with a discussion about a letter
sent by Dr. Brady on Sat. night around 9:30 pm. Mr. Schultz insisted
in adding the letter to the minutes of the meeting. Most members
opposed on the basis that most remarks in the letter were oriented to
provide his personal political views which were lacking the correct
information.
Dr. Brady has not been attending meetings nor participating in many
discussions. In my view, the minutes of the meeting should include
motions, votes and discussion during the meeting not letters from
members sent prior of the
meeting making statements on issues that we have not been discussed
yet."
[[[[[Nothing here that I can see is false. Mr. Brady reprints an
attack on himself from President Marinello.]]]]]
Due to a recent, and further, injury to my back, I will not be able to
attend the USCF Executive Board meeting in Boca Raton on December 19
and 20, 2004.
Please forgive my absence.
[[[[[Is Mr. Bauer claiming that Mr. Brady did not have a back injury --
was faking it? If so, what is his proof? I have heard that Mr. Brady
did indeed have health problems. If untrue, then Mr. Bauer needs to
explain.]]]]]
I would like to give a brief report as to how I see the state of
affairs of the USCF, and also to comment on the conduct of the meeting.
Therefore, I am making a formal request that you distribute copies of
this report to the other members of the Executive Board, and that you
read or place the report into the official minutes of the meeting.

introductory remarks.]]]]]
President Marinello's Report and the Move to Crossville
The first item on the proposed agenda for this meeting is the report by
president Beatriz Marinello. Although the report should contain a
general (and when necessary, specific) discussion of the current state
of affairs of the USCF, it is my opinion that there should be a lengthy
and informed report on the most serious matter ever to confront the
USCF: the proposed move to Crossville.
[[[[[Is Mr. Brady stating his opinion in the above a falsehood? I
don't think so.]]]]]
Despite the fact that the Executive Board has voted to make such a
move, the question arises whether the USCF can affordit. Perhaps the VP
of Finance and a member of the Re-location Committee, Timothy Hanke,
can aid in President Marinello's discussion of this crucial question.
As the cost of moving to Crossville now appears to be more exorbitant
than at first believed, someone on the Board (I would be happy to do so
by telephone) should make a motion that begs the Board for more time to
explore alternative measures. Obviously, we don't want to bankrupt the
USCF just to prove a point (that is, that Crossville is the better site
than others so far considered).
[[[[[What is false or contradictory in the above? Certainly cost
questions have arisen, and no one has denied that here -- on either
side. Is Mr. Bauer suggesting that Mr. Brady would not have introduced
the motion he claims that he would have? Is he saying that there is no
appearance of more exorbitant costs when he himself has said that even
if the costs double his private estimate of $200,000, the whole thing
will still be a splendid move?]]]]]
We all know of the political and personal debates surrounding this
issue, and the Board must be aware that three Board members (Brady,
Schultz, and Goichberg, as a non-voting member), have strongly warned
about the dangers of the move to Crossville. They are not the only
ones: a law suit opposing the move has been brought by a USCF member;
the President of the America's Foundation for Chess is opposed to it;
and many other chess leaders and members and delegates of the USCF are
equally against it.
[[[[[What's false here? Is the AF4C president really in favor of the
move? Was there no lawsuit? Are there not many opposed to the move?
Have there been no
political and personal debates? If there be a falsehood in the above,
let Mr. Bauer specify it.]]]]]
Bill Goichberg has been accused of wanting to keep the USCF office near
his own home, but since he is stepping down from his post in a matter
of weeks, this is no longer an issue, if it ever was. There are no
personal or political reasons why Schultz or Brady are so opposed to
the move to Crossville. We are simply worried about the financial and
organizational future of the USCF, and believe that the move to
Crossville could spell the ruination of the USCF as we know it.
[[[[[Stop right here. One might debate whether there are personal or
political reasons why the Messrs. Brady and Schultz oppose the move,
but I see no misstatement of provable fact or any falsehood in the
above.]]]]]
The offer of five years free rent in Liberty, New York, with an option
to buy (at an agreed-upon price) after that, seems like a dream come
true. However, at least one Board member has said that we should not
have taken that offer, even if the building was given to us for free,
and another Board member said that we should not consider the Liberty
offer because the bid came in a few days later than the deadline. Both
rationales are to be questioned, as neither one benefits the good of
the USCF.
[[[[[Mr. Brady makes specific claims here. Are they wrong? Are they,
in fact, arrant falsehoods that could possible rise to the level of a
lie? Tim Hanke DID say he would reject the Liberty bid even if it was
free? Can Mr. Bauer point out the falsehoods in the above about a great
opportunity in Liberty missed so that we could move to the Cumberland
Gap?]]]]]
I implore the Executive Board to issue a financial statement that would
clearly demonstrate whether or not the move to Crossville would not
damage the fragile finances of the USCF, and if there is any doubt, to
re-consider the move at this time and seek alternative quarters.
[[[[[What is false in the above statement? Is Mr. Bauer arguing that
Mr. Brady was not really imploring and secretly favors the move to
Cross-to-Bear? If so, hat proof has he that Mr. Brady secretly favors
moving to the Cumberland Gap? Is he saying that it is false to call
USCF finances "fragile"?]]]]]
Resignation of President Marinello
There has been much correspondence and many statements concerning
President Marinello's wish to step down from the presidency of the
USCF, and at the time of this writing, I have no information whether
she will or will not resign. The decision is hers. I think it is
important, however, that the Board realize that if there is a direct
connection between her resignation and her apointment to a full-time,
paid position with the USCF, it might be 1) illegal, 2) certainly
unethical, and 3) appear improper to the USCF membership.
[[[[[What is false in the above? Mr. Brady said that it might be
illegal and certain unethical were Beatriz Marinello to be appointed to
a job in the federation on a full-time paid basis. He said that he had
no idea whether Mrs. Marinello would resign. In any event, the Board
majority appointed Mrs. Marinello COO with $60,000 in annualized
"expenses." The majority appeared to agree with Mr. Brady.]]]]]
Quite honestly, I think that she has received poor legal advice as to
whether such a move is illegal or not, and I would urge all the Board
members to engage their own legal counsel as to whether a positive vote
in this direction would hold them personally liable.
[[[[[What is false in the above? Mr. Brady says he thinks Mrs.
Marinello has gotten some bad legal advice, and the Board majority
appears to have concurred, preferring to pay $60,000 in annualized
"expenses" rather than a direct salary. Is Mr. Brady uttering a
falsehood when suggesting that Board members contact lawyers? I can
see nothing in the above paragraph that is other than opinion or
suggestion.]]]]]
If there are no strings attached to President Marinello's resignation
(in that she has not been promised a paid job with USCF, and that no
inference has been made to that end), then she should resign her
presidency if she so chooses. At the point that she resigns the
presidency, the current Vice-President (in this case Steve Shutt)
immediately becomes President (DM04-38 - NDM 04-42, passed at the 2004
USCF Annual Meeting).
The vacancy that then exists for Vice-President must be filled by a
majority vote by the Executive Board. The only way that Mr. Shutt does
not assume the office of the President in this scenario is if he
personally refuses to take the position,
and then a majority vote by the Executive Board must be taken to fill
it.
[[[[[Is Mr. Batuer stating that Mr. Brady misidentified the Delegates'
motions in question? If so, what were they? If there is a wrong
motion number, is that a lie or falsehood from Mr. Brady or a typo?
Does the vice president take over? Does the EB select the new vice
president? What has Mr. Brady written that is either irresponsible or
untrue?]]]]]
Appointment of the New Executive Director
[[[[[That is as far as I have gotten. What is untrue so far? What must
be withdrawn? What rises to the level of sheer mendacity according to
Randy Bauer?]]]]]
