Author Sloan Suit tossed

God help me, I actually read something posted on Sam's site, in
particular the decision handed down by the court.

Essentially, the judge tossed Sam's suit for failure to follow proper
procedure. Imagine that. While it is without prejudice, meaning he
can come back, he also included this paragraph:

"Based on the complex nature of the issues involved, this Court
requires, pursuant to CPLR §1101(b), that this movant submit a
certificate of an attorney stating that the attorney has examined the
action and believes there is merit to the moving party's contentions.
The attorney should address issues such as standing and the
appropriateness of the remedies requested (including the issuance of
an injunction against an official of another state)."

These are sufficiently complex issues that no lawyer worth his salt
would file such an affidavit without some significant research.
Hopefully, none of my brothers in the NY bar will assist the looney,
and this will be a dead issue.

There is justice.

I know Attorney Don Aldrich. Attorney Don Aldrich is a friend of mine. Sam
Sloan is no Don Aldrich.

You are both wrong. The suit is not tossed. I paid the filing fee of
$305 on Friday, November 12. In a strange ruling, the clerk of court
decided that I had to re-file it under a new index number. So the case
now has a new index number of 2004-7739.

The new suit is definately still pending because by the time I paid
the filing fee, the judge was gone for the day, so the first time he
could rule upon it would be Monday, which is later today.

It is good to hear that nobody in New York will assist Looney &
Looney, the Crossville Tennessee law firm that started this whole
thing by threatening to sue the USCF Board if the USCF did not move to
Crossville.

Note that when you do a search at the above address, you will find
that they spelled the name of Beatriz Marinello wrong. They spelled it
Mariello.

You are not nearly as great an attorney as you claim to be.

That is not what the judge wrote at all. He wrote that I must either
pay the $305 filing fee or provide an affidavit from an attorney, but
not both.

Sam,

My bridge partner, who lives a few blocks away from you, is also an amaateur
litigator. It's a waste of time. Even when you're right, they find a way to
screw you.

After a couple of glasses of wine even George says so, and he's one of the
most stubborn people who's ever been born.

You'll have better luck changing their minds by filling paper bags with
puppy-trek, ringing their doorbells, setting the bag on fire, and running.

This is certainly true and I always say that no matter how air-tight a
court case might seem to be, the judge will often make some wacko or
crazy ruling and there is nothing you can do about it.

I know this better than anyone because I had my mother and my daughter
both KIDNAPPED by completely crooked Virginia judges and there has
been nothing I could do about it.

That is why I ran for Congress so that if I get elected I can have
those peoiple arrested and put in prison where they belong.

However, this works two ways. I would not want to be one of the four
board members of the USCF who voted in favor of the move where they
could go to prison for this, not to mention the possibility that one
of the 25 people who is losing their job because of their acts might
be more than a little upset over this.

to lock up the people you don't like? Is that part of the Homeland
Security Law?

Yes, and I am glad that you understood that legal point.

The Homeland Security Law does indeed give those in charge the right
to lock up indefinitely anybody they do not like, regardless of
whether any violation of law is involved.

Remember that he claimed that I would lose my case against the Taxi
and Limousine Commission, but I won that case.

Here again, he claimed that my case had been thrown out of court, but
as everybody can see now, my case is going strong with a hearing
scheduled for November 30.

Is Dumbo/Dondo really a lawyer and is he really a good one?

It was not rocket science to see that I had a legally sound case.

Sam, you are such an idiot. It is criminal that the likes of you is
about to cost our federation money due to your insane view of the
world.

An 'order to show cause' is not a victory. It is nothing more than a
notice of motion. That you had to do it twice does not bode well for
your success.

I am confident you will not survive the hearing with your case in
tact. The only question is whether you will be appropriately
sanctioned for your actions in bad faith.

refuses to respond.

Our jailhouse lawyers will not decide this case. A judge, who is far
removed from the hatreds and jealousies of rgcp, will render a decision.

Sam's case has evident merit. The issue will be whether a judge will
overturn a major organizational decision -- a horrendous intervention and
enormous sanction -- based on the Board violating its own bylaws. The odds are
against Sam's case, but the fact of bylaws violation has created enough

In the first place, he calls this a "Sloan thread". As anybody can
see, this is not a Sloan thread. This is a Dondo thread. Go look at
the top. Dondo started this thread.

Secondly, he claims that the Sloan suit has been tossed. It has not
been tossed. It is going stronger than ever.

Thirdly, an order to show cause is not a notice of motion., I have to
wonder if Dondo is really the lawyer he claims to be. Before the judge
signed the order, he reviewed it for legality. By the way, the judge's
law clerk is an author of law books, which is rare and unusual.

Fourthly, it is Dondo who is costing the federation money by
expressing views about New York Law when he is not licensed to
practice in New York, which will lead his political allies to have a
false sense of security and indeed arrogance which will cause them to
fall a lot harder if and when I win this case.

Yes, and I am glad that you understood that legal point.

The Homeland Security Law does indeed give those in charge the right
to lock up indefinitely anybody they do not like, regardless of
whether any violation of law is involved.

This is certainly true and I always say that no matter how air-tight a
court case might seem to be, the judge will often make some wacko or
crazy ruling and there is nothing you can do about it.

I know this better than anyone because I had my mother and my daughter
both KIDNAPPED by completely crooked Virginia judges and there has
been nothing I could do about it.

That is why I ran for Congress so that if I get elected I can have
those peoiple arrested and put in prison where they belong.

However, this works two ways. I would not want to be one of the four
board members of the USCF who voted in favor of the move where they
could go to prison for this, not to mention the possibility that one
of the 25 people who is losing their job because of their acts might
be more than a little upset over this.

Our jailhouse lawyers will not decide this case. A judge, who is far
removed from the hatreds and jealousies of rgcp, will render a decision.

Sam's case has evident merit. The issue will be whether a judge will
overturn a major organizational decision -- a horrendous intervention and
enormous sanction -- based on the Board violating its own bylaws. The odds are
against Sam's case, but the fact of bylaws violation has created enough
uncertainty that members of the inner circle are unsure of the outcome.
